ORDER PHOTOS
Photographer/Client Agreement
Houston Real Estate Photography, LLC assumes no liability, whatsoever, for the condition or appearance of the property/subject. Client is solely responsible for ensuring that the property/subject is photo-ready at the agreed photography appointment date and time.
Client agrees, unconditionally, to immediately pay Photographer all sums due for this order, including any client modifications thereof, upon performance of the requested services, or receipt of Photographer's invoice, whichever occurs first.
Upon receipt of payment in full for all services rendered under this order, Photographer grants to Client a non-exclusive, worldwide, royalty-free license to publish, display, reproduce, create derivative works of and distribute the Photographs in connection with the real estate industry, including but is not limited to, such uses of the Photographs in connection with advertising real property, and to authorize and sublicense such rights to third party listing and marketing services, at Client’s discretion. This license shall be limited to a one-time effort to market the subject property, or other products appearing in the photos, absent explicit agreement between the parties, otherwise.
Client acknowledges that Photographer retains title and ownership of all Photographs, unless otherwise agreed to in writing.
Photographer is an independent contractor of Client and nothing in this agreement should be construed to create a partnership, or joint venture, between Photographer and Client.
This agreement is made in Harris County, Texas.
